Symptom Checker Applications (SCA) are mobile applications often designed for the end-user to assist with symptom assessment and self-triage. SCA are meant to provide the user with easily accessible information about their own health conditions. However, SCA raise questions regarding ethical, legal, and social aspects (ELSA), for example, regarding fair access to this new technology. The aim of this scoping review is to identify the ELSA of SCA in the scientific literature. A scoping review was conducted to identify the ELSA (...) of SCA. Ten databases (e.g., Web of Science and PubMed) were used. Studies on SCA that address ELSA, written in English or German, were included in the review. The ELSA of SCA were extracted and synthesized using qualitative content analysis. A total of 25,061 references were identified, of which 39 were included in the analysis. The identified aspects were allotted to three main categories: (1) Technology; (2) Individual Level; and (3) Healthcare system. The results show that there are controversial debates in the literature on the ethical and social challenges of SCA usage. Furthermore, the debates are characterised by a lack of a specific legal perspective and empirical data. The review provides an overview on the spectrum of ELSA regarding SCA. It offers guidance to stakeholders in the healthcare system, for example, patients, healthcare professionals, and insurance providers and could be used in future empirical research to investigate the perspectives of those affected, such as users. Background Symptom checker apps (SCAs) are mobile or online applications for lay people that usually have two main functions: symptom analysis and recommendations. SCAs ask users questions about their symptoms via a chatbot, give a list with possible causes, and provide a recommendation, such as seeing a physician. However, it is unclear whether the actual performance of a SCA corresponds to the users’ experiences. This qualitative study investigates the subjective perspectives of SCA users to close the empirical gap identified in (...) the literature and answers the following main research question: How do individuals (healthy users and patients) experience the usage of SCA, including their attitudes, expectations, motivations, and concerns regarding their SCA use? Methods A qualitative interview study was chosen to clarify the relatively unknown experience of SCA use. Semi-structured qualitative interviews with SCA users were carried out by two researchers in tandem via video call. Qualitative content analysis was selected as methodology for the data analysis. Results Fifteen interviews with SCA users were conducted and seven main categories identified: (1) Attitudes towards findings and recommendations, (2) Communication, (3) Contact with physicians, (4) Expectations (prior to use), (5) Motivations, (6) Risks, and (7) SCA-use for others. Conclusions The aspects identified in the analysis emphasise the specific perspective of SCA users and, at the same time, the immense scope of different experiences. Moreover, the study reveals ethical issues, such as relational aspects, that are often overlooked in debates on mHealth. Both empirical and ethical research is more needed, as the awareness of the subjective experience of those affected is an essential component in the responsible development and implementation of health apps such as SCA. Fünfzehn Jahre nach ihrer Entstehung ist die Neuroethik ein internationales wissenschaftliches Feld mit enormer Dynamik. Innerhalb weniger Jahre wurden eigene Kongresse, Zeitschriften, Forschungsförderprogramme, Fachgesellschaften und Institute gegründet. Gleichwohl besteht erheblicher Dissens über die Definition und den Gegenstandsbereich dieses neuen Gebiets. Wir argumentieren hier für eine differenzierte Konzeption, wonach neben der Reflexion ethischer Probleme der Neurowissenschaft und ihrer überwiegend neurotechnologischen Anwendungen auch die ethische Reflexion neurowissenschaftlicher Forschung zur Moralität zur Neuroethik gehört. Dies umfasst zwar nicht neurowissenschaftliche oder neuropsychologische Studien zur Moralität, (...) wohl aber die Reflexion der Bedeutung dieser Forschung für die Ethik und das Recht. Wir geben einen Überblick über die wichtigsten Themen der Neuroethik, woraus deutlich wird, wie sehr in verschiedenen gesellschaftlichen Bereichen, auch jenseits von Medizin und Gesundheitswesen, neuroethische Fragen relevant sind. Das Potenzial der Neuroethik als eines neuen Wissenschaftsfeldes liegt darin, durch eine Verknüpfung neurophilosophischer und medizinethischer Themen sowie eine breite interdisziplinäre Vernetzung neue Antworten auf gesellschaftlich drängende Fragen zu finden. The article reassesses the renown ‘critical iconology’ practiced by Aby Warburg and confronts it with recent theories regarding metadata and the curatorship of information. A close examination of Robert Kitaj’s portrait Warburg as a Maenad (1961–62) affirms Warburg’s ‘combinatory experiments’ (Christopher D. Johnson) to be a main characteristic of his practice. Warburg seems to have operated by applying what can now be described as metadata to the processes of transmission of culture he was accessing in form of migrating images. Further, (...) the insights he was able to gain, namely his famous notion of the ‘Pathosformel’, may have to be considered as a specific form of metadata too. This is of particular interest acknowledging that in the digital world the migration of images takes mainly place in the realm of metadata. Hence ideas put forward by Warburg are able contribute to a deeper understanding of such phenomena. (shrink)

Ausgehend von einer Bestimmung der ästhetischen Erfahrung als Erfahrung der Art und Weise der sinnlichen Gegebenheit von Gegenständen und Umwelten geht der vorliegende Text der Frage nach den Spezifika alltagsästhetischen Erfahrens nach. Dabei wird zunächst die alltagsästhetische Einstellung als eine fest in den handelnden Vollzug gewohnter Praktiken und Routinen eingebettete Wahrnehmungshaltung bestimmt. In einem nächsten Schritt werden charakteristische Merkmale alltagsästhetischen Erfahrens herausgearbeitet: Zu nennen sind die Wahrnehmung von – theoretisch näher zu beschreibenden – Ganzheiten, die Kategorien des Vertrauten, des Rhythmus (...) und des Takts sowie schließlich das Zusammenspiel aller Sinne. ZusammenfassungParallel zu einer noch immer weitestgehenden Tabuisierung von Homosexualität und normabweichendem Geschlecht im Leistungssport haben sich im Bereich des Breitensports in der Vergangenheit zahlreiche queere Sportvereine gegründet, die insbesondere homo-, bisexuelle, Trans*- und Inter-*, Non-Binary- bzw. queere Personen zur Zielgruppe haben. Der vorliegende Beitrag basiert auf einer qualitativ angelegten Interviewstudie, in der Mitglieder eines queeren (LGBTI*) Sportvereins zu ihren Sporterfahrungen und Motiven der Partizipation befragt wurden. Die Befunde zeigen, dass nicht nur auf Heteronormativität basierende Negativerfahrungen im herkömmlichen Verein ausschlaggebend sind, (...) sondern auch die Selbstsegregation innerhalb des queeren Vereins eine eigene Anziehungskraft hat. Dabei erweist sich der Verein für die Befragten als Gemeinschafts- und Wohlfühlraum, Kontaktbörse oder auch als mentaler Schutzraum. Im Beitrag werden die Bedeutungsfacetten des queeren Vereins ausdifferenziert beschrieben und kritische Perspektiven hinsichtlich der Teilnahme am queeren Sport aufgezeigt. (shrink)

The paper develops a conception of the good life within a digitalized society. Martha Nussbaum’s capability theory offers an adequate normative framework for that purpose as it systematically integrates the analysis of flourishing human lives with a normative theory of justice. The paper argues that a theory of good digital lives should focus on everyday life, on the impact digitalization has on ordinary actions, routines and corresponding practical knowledge. Based on Nussbaum’s work, the paper develops a concept of digital capabilities. (...) Digital capabilities are combined capabilities: To possess a digital capability, an individual must acquire certain skills and abilities (internal capabilities) and needs access to devices and external infrastructures like internet connections. If societies as a whole and everyday environments are digitalized to a certain degree, the possession of specific digital capabilities is a crucial precondition for a flourishing life. The paper likewise analyzes challenges that are connected to digital capabilities. Digital structures are constantly changing. In consequence, digital capabilities are never acquired once and for all, but always precarious and in danger of being lost—with serious consequences for individual everyday lives in digitalized environments. As digital capabilities are crucial for leading a good life, people are entitled to develop and maintain them. They describe demands of justice. Using the examples of filling in an online form and digital education, the paper finally illustrates the size of institutional changes that are necessary to meet these demands. (shrink)

Contribution for book symposium on Andrea Sangiovanni's Humanity without Dignity.

Der weitaus größte Teil des menschlichen Lebens besteht aus Alltäglichem, aus eingespielten Abläufen und praktischen Routinen in wohlvertrauten Kontexten und Umwelten. Umso überraschender ist es, dass die Frage nach den spezifischen Strukturen und Gelingensbedingungen alltäglichen Lebens in den breiten Debatten um Theorien des guten Lebens kaum eine Rolle spielt. Der vorliegende Aufsatz enthält einen Vorschlag zur Konzeptualisierung gelingenden Alltags und seiner Voraussetzungen. Dazu führe ich zunächst eine politische Theorie des Guten ein, den capability approach in der von Martha Nussbaum entwickelten (...) Fassung (Abschnitt 1), und argumentiere anschließend für die These, dass Alltag als routinierter Lebensvollzug in der je eigenen Lebenswelt verstanden werden sollte (Abschnitt 2). Auf Grundlage dieser Überlegungen kann die Leitfrage beantwortet werden: Wie gelingt Alltag (Abschnitt 3)? Dabei gehe ich davon aus, dass das Gelingen individuellen Alltags maßgeblich von gesellschaftlichen Voraussetzungen abhängt, die sich im Rahmen einer politischen Theorie des Guten analysieren und kritisieren lassen. One of the consequences of global warming is reduced final body sizes in animals of different orders, mainly in aquatic ectotherms like fish or water-breathing invertebrates. In this article, we identify August Pütter (1879–1929) as the originator of what is now called the “temperature–size rule” and as the first physiologist to develop a mechanistic explanation for this phenomenon. While Pütter’s growth model was indirectly influential through its adaptation by Ludwig von Bertalanffy (1901–1972), his explanation of the influence of temperature on (...) growth remained either unknown or misunderstood. In this contribution, we reconstruct the theoretical framework of his model and compare it to recent critiques of mechanistic models on growth and temperature. As we argue, Pütter’s theory of “similarities of growth” provides explanations for observed temperature–size patterns trends that avoid later accounts of underlying “biological laws.” While recent findings suggest that some aspects of Pütter’s model need revision—for example, the proposed exponents of the anabolic and catabolic terms in his growth equation—we argue that his mechanistic model was designed in a way that could account for the multiple apparent exceptions to the temperature–size rule that were recently found. Recent controversy about the use of the vertebrate fossil record for external calibration of molecular clocks centers on two issues, the number of dates used for calibration and the reliability of the fossil calibration date. Viewing matters from a palaeontological perspective, we propose three qualitative, phylogenetic criteria that can be used within a comparative framework for the selection of well-constrained calibration dates from the vertebrate fossil record. On the basis of these criteria, we identify three highly suitable new fossil calibration (...) dates for molecular clock estimates: the lungfish–tetrapod split (between 419 and 408 Ma), the bird–crocodile split (between 251 and 243 Ma), and the alligator–caiman split (between 71 and 66 Ma). Together with our previously suggested bird–lizard split (between 252 and 257 Ma), these four fossil dates span a range of very different ages. They are, in our opinion, more suitable for molecular clock calibration than the traditionally used mammal–bird split, which is less well constrained. BackgroundThe rise of Big Data-driven health research challenges the assumed contribution of medical research to the public good, raising questions about whether the status of such research as a common good should be taken for granted, and how public trust can be preserved. Scandals arising out of sharing data during medical research have pointed out that going beyond the requirements of law may be necessary for sustaining trust in data-intensive health research. We propose building upon the use of a social (...) licence for achieving such ethical governance.Main textWe performed a narrative review of the social licence as presented in the biomedical literature. We used a systematic search and selection process, followed by a critical conceptual analysis. The systematic search resulted in nine publications. Our conceptual analysis aims to clarify how societal permission can be granted to health research projects which rely upon the reuse and/or linkage of health data. These activities may be morally demanding. For these types of activities, a moral legitimation, beyond the limits of law, may need to be sought in order to preserve trust. Our analysis indicates that a social licence encourages us to recognise a broad range of stakeholder interests and perspectives in data-intensive health research. This is especially true for patients contributing data. Incorporating such a practice paves the way towards an ethical governance, based upon trust. Public engagement that involves patients from the start is called for to strengthen this social licence.ConclusionsThere are several merits to using the concept of social licence as a guideline for ethical governance. Firstly, it fits the novel scale of data-related risks; secondly, it focuses attention on trustworthiness; and finally, it offers co-creation as a way forward. Greater trust can be achieved in the governance of data-intensive health research by highlighting strategic dialogue with both patients contributing the data, and the public in general. Behavioural phenotypes have been explained by genetic and environmental factors (E) and their interaction. Here we suggest a rethinking of the E factor. Passively incurred environmental influences (E pass) and actively copied information and behaviour (E act) may be distinguished at shared and non-shared level. We argue that E act underlies mutation and selection and is the base of gene-independent heritability.

Was ist die Rolle der akademischen Philosophie angesichts der Klimakrise? Können und sollen Philosoph:innen aktivistische Bewegungen unterstützen oder sogar selbst zu Aktivist:innen werden – oder sich eher auf die theoretische Reflexion konzentrieren? Die Herausforderungen der Klimakrise an der Schnittstelle von philosophischer Reflexion, institutioneller Praxis und individuellem Engagement standen im Mittelpunkt des Panels „Philosophie und Klima-Aktivismus“ der AG Nachhaltigkeit der DGPhil sowie der GAP im Rahmen des DKPhil 2024.

Zusammenfassung: Obwohl sich die „Philosophie der Stadt“ in den letzten Jahrzehnten dynamisch entwickelt hat, stellt sie noch keine klar konturierte philosophische Teildisziplin dar. Dieser Zustand birgt Chancen und Probleme: Die aktuellen Debatten sind vielschichtig und kreativ, die Potentiale verschiedener Theorien, Traditionen und Methoden zur philosophischen Erschließung der Stadt werden erprobt und kombiniert. Zugleich zeigt sich nach wie vor eine gewisse Unsicherheit hinsichtlich der genauen Ziele und Aufgaben einer Philosophie der Stadt sowie hinsichtlich ihres Verhältnisses zu anderen Disziplinen der Stadtforschung. ZusammenfassungBasierend auf einer systematischen Literaturrecherche über den Sport im Strafvollzug geht das Review der Frage nach, wie die Inhaftierten den Gefängnissport erfahren und reflektieren. Gestützt auf zehn qualitative Studien werden die zentralen Bedeutungsfacetten des Sports in der Haft herausgearbeitet. Grundsätzlich wird darauf verwiesen, dass der Sport für die Häftlinge ein wichtiges Medium bei der Bewältigung der mit der Inhaftierung typischerweise einhergehenden negativen Begleiterscheinungen ist: Die Teilnahme am Sport ermöglicht es ihnen, die Monotonie und Langeweile des Gefängnisalltags aufzubrechen, Stress abzubauen und (...) das Gefühl von sozialer Isolation zu reduzieren. Darüber hinaus bietet der Gefängnissport in einer totalitären Institution eine der wenigen Nischen, in denen sich die (männlichen) Gefangenen temporär als selbstbestimmte Subjekte erfahren können. Negative Einflüsse des Sports werden in bisherigen Studien kaum thematisiert, ebenso wenig wird Sport als Mittel der Resozialisierung gesehen. Vor diesem Hintergrund werden Forschungslücken und Perspektiven für zukünftige Studien aufgezeigt. (shrink)

Definition of the problem Digital health technologies have gained significant importance in recent years. These technologies include symptom checker apps which use algorithms or artificial intelligence to provide users with analyses and recommendations based on their symptom input. Despite their widespread recognition, research shows mixed results regarding the accuracy of these apps, thus, limiting their current utility. The interdisciplinary CHECK.APP project examined the ethical, legal, and social aspects associated with symptom checker apps. Arguments The resulting recommendations presented here are directed (...) towards various stakeholders, including users, physicians, developers, and public institutions. It is crucial to adopt a critical stance towards the use of symptom checker apps, promote health literacy and eHealth literacy, and ensure transparency regarding the data basis and user experiences. Moreover, there is a need for reliable and independent information sources that allow users and physicians to stay informed about current developments in the digitalization of healthcare. At the same time, developers are encouraged to follow clear guidelines on transparency, quality assurance, and accessibility. Additionally, policymakers are recommended to ensure the voluntary use of symptom checker apps and to create conditions that strengthen the health literacy of the population. Conclusion The recommendations presented here outline how symptom checker apps can be used responsibly to maximize potential benefits and minimize risks. (shrink)

This paper offers an account of Susan Haack’s philosophy of law and points out several aspects within the legal pragmatist tradition that deserve further discussion. Firstly, a systematic presentation of legal pragmatism as it is defended by Haack, who follows Justice Oliver W. Holmes here, is given. Secondly, the limits of an evolutionary perspective of law recommended by legal pragmatism are considered. Finally, the paper discusses whether legal pragmatism is able to handle different legal traditions, thereby focusing on Anglo-American common (...) law and European civil law. (shrink)

In the beginning of the 1780 s the Berliner popular pastor und foremost „Neologe“ Johann Joachim Spalding was involved into a conflict which was about the implementation of a new hymnbook. Spalding defended this new hymnbook against all critics in his „Predigt von dem, was erbaulich ist“. The analysis of this conflict can be seen as a contribution to a precise understanding of the controversities in the late enlightenment. Current challenges to sustaining public support for health data research have directed attention to the governance of data-intensive health research networks. Accountability is hailed as an important element of trustworthy governance frameworks for data-intensive health research networks. Yet the extent to which adequate accountability regimes in data-intensive health research networks are currently realized is questionable. Current governance of data-intensive health research networks is dominated by the limitations of a drawing board approach. As a way forward, we propose a stronger focus (...) on accountability as learning to achieve accountable governance. As an important step in that direction, we provide two pathways: (1) developing an integrated structure for decision-making and (2) establishing a dialogue in ongoing deliberative processes. Suitable places for learning accountability to thrive are dedicated governing bodies as well as specialized committees, panels or boards which bear and guide the development of governance in data-intensive health research networks. A continuous accountability process which comprises learning and interaction accommodates the diversity of expectations, responsibilities and tasks in data-intensive health research networks to achieve responsible and effective governance.
